10.1 General Right to Refund. The Client shall be entitled to request a refund where the Services have not been commenced, have not been delivered in accordance with the agreed requirements, or otherwise fail to comply materially with the terms of the Client’s order.
10.2 Change of Mind. The Client may cancel the order and receive a 100% refund at any time before the Company’s writers, editors, or other personnel commence substantive work on the project. The Client may also cancel within one (1) hour of placing the order and receive a full refund, regardless of whether work has commenced. No processing or cancellation fee shall apply where the Client exercises this right within the one-hour period.
10.3 Cancellation After One Hour. If the Client cancels after one (1) hour but before meaningful work has commenced, the Client shall remain entitled to a full refund. Where substantive work has commenced, any deduction must be reasonable, proportionate to the demonstrable work actually completed, and disclosed to the Client in writing before the refund is processed. No deduction may exceed 40% of the amount paid.
10.4 Non-Conforming or Incompetent Delivery. If the delivered work does not materially comply with the Client’s written project requirements, specifications, instructions, or agreed scope, the Client may request a refund. The Company shall first provide revisions at no additional cost and shall continue revising, correcting, or reassigning the work as reasonably necessary to bring the deliverable into conformity with the Client’s requirements.
10.5 Client’s Right to Reject Unsatisfactory Work. If, after reasonable revision opportunities, the Company is unable to deliver work that materially conforms to the agreed requirements, the Client may reject the deliverable and request a refund. The refund shall be determined based on the extent of the non-conformity, with the Client entitled to a full refund where the delivered work is substantially unusable or materially fails to satisfy the agreed project requirements.
10.6 No Waiver Through Acceptance of Revisions. The Client’s request for revisions, review of drafts, communication with the Company, or reasonable attempt to resolve an issue shall not constitute acceptance of defective or non-conforming work and shall not waive the Client’s right to seek a refund.
10.7 Late Delivery. If the Company fails to deliver the Services by the agreed deadline, the Client may notify the Company and provide a reasonable opportunity to cure the delay. If the Company fails to deliver within the additional reasonable period specified by the Client, the Client may cancel the order and receive a full refund. The Client shall not be required to make three separate contact attempts where the Company has actual notice of the missed deadline.
10.8 Company-Caused Delays. Where a delay is caused wholly or substantially by the Company, its personnel, contractors, systems, or service providers, the Client shall be entitled to an appropriate refund, including a full refund where the delay defeats the purpose of the order. The burden of demonstrating that a delay was caused by the Client shall rest with the Company.
10.9 Refund Request Period. The Client may submit a refund request within one hundred eighty (180) days following delivery or, where no delivery occurs, following the agreed delivery date. Where the Client could not reasonably discover the relevant defect within that period, the refund period shall begin when the defect was reasonably discovered.
10.10 Technical and Minor Errors. Minor errors, including typographical, grammatical, formatting, word-count, or reference issues, shall ordinarily be corrected promptly and at no additional cost. Such issues shall not automatically prevent the Client from seeking a refund where they are numerous, recurring, materially affect the usefulness of the deliverable, or demonstrate substantial non-compliance with the agreed requirements.
10.11 Quality-Related Complaints. The Client may seek a refund where the Services materially fail to meet the agreed quality, scope, specifications, or professional standards represented by the Company. The Company shall not reject a valid refund request merely by characterizing the Client’s complaint as general dissatisfaction.
10.12 Client-Caused Delays. The Company shall not be responsible for delays demonstrably caused solely by the Client’s failure to provide information, materials, approvals, or instructions reasonably required to perform the Services. The Company must promptly notify the Client of any such dependency and its potential effect on the delivery date. Any delay not properly documented and communicated shall not automatically be attributed to the Client.
10.13 Refund Processing. Once a refund has been approved or becomes due under this Section, the Company shall process the refund within seven (7) business days using the original payment method, unless the Client expressly agrees otherwise.
10.14 No Unilateral Waiver of Client Rights. Nothing in this Section shall be interpreted to limit any non-waivable rights or remedies available to the Client under applicable law. In the event of any ambiguity, this Section shall be interpreted in a manner reasonably favorable to the Client.
10.15 Evidence and Fair Review. Any dispute concerning eligibility for a refund shall be reviewed in good faith based on the order, agreed requirements, communications, drafts, delivery records, and other relevant evidence. The Company shall provide the Client with a reasonable explanation of any proposed deduction or denial and shall not unreasonably withhold or delay a refund.
10.16 Refunds for Material Breach. If the Company materially breaches its obligations under the applicable agreement and fails to cure such breach within a reasonable period after receiving notice, the Client may terminate the applicable order and receive a refund of amounts paid for Services not properly provided, without prejudice to any other rights or remedies available to the Client under applicable law.
